"accu-fant on Tour": Conditions of participation with data protection information

The organiser of the ‘accu-fant on Tour’ competition is BRAND GMBH + CO KG, Otto-Schott-Str. 25, 97877 Wertheim (‘BRAND’ or ‘Organiser’).

Participation

1. participation in the competition takes place by uploading photos to the BRAND website.
2. persons who have reached the age of 16 and are resident within the European Union (‘Participants’) are eligible to participate, unless they are members of the jury. Persons under the age of 18 may only participate with the consent of a parent or legal guardian. Each participant may only participate on his/her own behalf. False personal details may lead to exclusion.
3. the organiser reserves the right to exclude participants who violate these conditions of participation or act fraudulently by undue influence or manipulation or in any other way. In such cases, prizes may also be subsequently rejected or reclaimed.
4 Participation in the competition is free of charge and is not linked to any other services provided by the participant. Any costs for Internet access and use are to be borne by the participants.
5. participants agree that in the event of winning, the winning photo together with the first names of the winners may be published on the Brand Group's social media channels to provide information about the competition.  

Procedure of the competition

1. the competition starts on 15.10.2024. You can upload your creative accu-fant on Tour photos on the website https://www.brand.de/accu-fant until 30.09.2025 at 23:59. Late entries will not be considered.
2. the images can be uploaded in jpeg, png or bmp format. The file size must not exceed 10 megabytes. Post-processing of the images is generally permitted as long as the original character of the motif is retained. When uploading the image, an e-mail address must be provided which will be used to send the prize in the event of a win.
3. by submitting the images, you declare that any persons depicted in the images agree to the recording and submission of the image, including possible publication of the winning images. If persons under the age of 16 are depicted in the submitted pictures, the consent of both the person depicted and their legal guardians must be obtained.
4. by submitting the images, you confirm that you are the author of the images or that you have the right to reproduce, forward and publicise the images.
5. the submitted images must not contain any illegal or inappropriate content. In particular, they must not contain or suggest any obscene, offensive, defamatory, ethically objectionable, violence-glorifying, pornographic, racist, xenophobic or insulting or otherwise objectionable images, contain any advertising on their own behalf or advertising for brands or violate copyright, personality, trademark or competition law. Any violation of this condition will result in immediate exclusion from the competition. BRAND reserves the right to remove from the website any images that may violate this rule.

Determination of the winners

1. an independent jury will select the 10 winning photos from all the uploaded images.
2. 10x accu-fant in BRAND new colour will be awarded. Each participant will also receive a BRAND lab mug.
3. the winners and other participants will be contacted within one month of the end of the competition at the e-mail address provided when uploading the photos, with the request to provide an address for sending the prizes. If a participant does not comply with this request within a further 14 days, the entitlement to the prize will lapse. The winner is responsible for the completeness and accuracy of his/her data.
4. the prizes are generally sent by post; the associated postage costs shall be borne by BRAND. Any additional costs associated with claiming the prize shall be borne by the winner/participant. Cash payment or transfer of the prize is excluded.

Premature termination of the competition


The organiser reserves the right to terminate or cancel the competition at any time without prior notice and without giving reasons. This applies in particular if the competition cannot be held as planned, in the event of technical obstacles (e.g. computer viruses, manipulation or errors in the hardware or software) or for legal reasons. If such a cancellation of the competition is caused by a participant, the organiser may claim compensation from this participant for the damage incurred.

Rights of use

The participants grant the companies of the Brand Group non-exclusive rights of use to the uploaded images for the realisation of the competition and the reporting on it, unlimited in terms of space and time, including the right to edit or transfer them into other work forms, provided that neither the content nor the presentation leads to a distortion of meaning or inappropriate alienation of the work. The right to name the author is expressly waived.

Liability

The organiser shall only be liable for damages incurred by participants due to material defects and/or defects of title in the event of malice, intent or gross negligence. Otherwise, liability for material defects and/or defects of title is excluded.

Miscellaneous

Legal recourse is excluded. The law of the Federal Republic of Germany shall apply exclusively. The applicability of mandatory provisions of the country in which participants have their habitual residence at the time of their participation in the competition remains unaffected by this choice of law. Insofar as individual provisions are or become invalid, this shall not affect the validity of the remaining provisions of these conditions of participation. The organiser may amend these conditions of participation at any time. The place of jurisdiction is Frankfurt am Main.
