The organizer of the Christmas competition is BRAND GMBH + CO KG, Otto-Schott-Str. 25, 97877 Wertheim (“BRAND”). The competition is not affiliated with Instagram/Meta and is in no way sponsored, supported, or organized by Instagram and does not establish any legal claim against Instagram. BRAND is the sole contact and responsible party.
1. Participation in the Christmas competition takes place via the brand_forlab Instagram account.
2. Persons who are at least 18 years of age and reside in the European Union, the EEA, Switzerland, or the United Kingdom (“participants”) are eligible to participate. Participation is only possible with your own Instagram account that is public or viewable upon request. Each user can only participate on their own behalf. Providing false personal information may result in disqualification. Employees of the Brand Group are excluded from the competition.
3. BRAND reserves the right to exclude participants who violate these terms and conditions or who act fraudulently through improper influence, manipulation, or other means. In such cases, prizes may also be subsequently refused or reclaimed.
4. Participation in the competition is free of charge and not linked to any other services provided by the participant. Any costs for internet access and use are to be borne by the participants.
1. The competition starts on Sunday, December 7, 2025, and ends on Monday, December 15, 2025, at 11:59 p.m. (CET). Late entries cannot be considered.
2. To participate in the prize draw, participants must subscribe to the brand_forlab channel on Instagram, like the competition post and add a comment to be announced in the competition post, and share the competition post in their story. Note: Since Instagram stories are only visible for a limited time, BRAND may request a screenshot as proof. Alternatively, the story must still be active at the time of evaluation.
3. The prizes are:
a) 1st prize: 1x Amazon voucher worth €100 and 1x miniature transfer pet in gold (color variant, not real gold);
b) 2nd prize: 1x Amazon voucher worth €50 and 1x miniature transfer pet in gold (color variant, not real gold);
c) 3rd prize: 1x Amazon voucher worth €25 and 1x miniature transfer pet in gold (color variant, not real gold).
The redemption of Amazon vouchers is governed exclusively by the respective terms of use of Amazon (e.g., amazon.de). Amazon is not a sponsor of the competition.
4. The three winners will be selected at random on Tuesday, December 16, 2025, announced in an Instagram story, and contacted via direct messaging (DM). Winners must respond within 48 hours via DM, providing their first and last names and, if applicable, their postal address. If a winner does not respond within this period, their claim to the prize will expire and a new winner will be drawn. The winner is responsible for the completeness and accuracy of their data. The winner's Instagram username will be published on BRAND's Instagram account.
5. The prizes will be sent to the winner free of charge within 8 weeks of the winner's response or handed over in person by a field service employee. Cash payment or transfer of the prize is excluded.
6. Comments posted by participants must be free of third-party rights and may not contain any illegal or inappropriate content. In particular, they may not contain any offensive, racist, discriminatory, or pornographic content, may not contain any self-promotion or promotion of other brands, and may not violate copyright, personal rights, trademark, or competition law. The participant remains solely responsible for their post. BRAND reserves the right to delete comments without giving reasons if, in BRAND's opinion, they violate these conditions of participation. If participants submit images/videos or recognizably agree to reposting, the participant grants BRAND a simple, free right of use, limited in terms of space and time to the context of the competition, for reproduction on BRAND's social media channels. Any further use requires separate consent.
7. BRAND reserves the right to terminate or cancel the competition at any time without prior notice and without giving reasons. This applies in particular if the competition cannot be held as planned, in the event of technical obstacles (e.g. computer viruses, manipulation or errors in the hardware or software) or if there are legal reasons. If such a termination of the competition is caused by a participant, BRAND may claim compensation from that participant for the damage incurred.
BRAND shall only be liable for damages incurred by the winner due to material defects and/or defects of title in cases of fraudulent intent, intent, or gross negligence. Otherwise, liability for material defects and/or defects of title is excluded.
Legal recourse is excluded. The law of the Federal Republic of Germany applies exclusively. The applicability of mandatory provisions of the country in which participants have their habitual residence at the time of their participation in the competition remains unaffected by this choice of law. If individual provisions are or become invalid, this shall not affect the validity of the remaining provisions of these conditions of participation. BRAND may change these conditions of participation at any time. The place of jurisdiction is Frankfurt am Main, Germany.

Purposes and legal basis: We process participants' personal data for the purpose of conducting and processing the competition (e.g., determining the winners, notifying them, shipping/transmitting the prizes) on the basis of Art. 6 (1) lit. b GDPR (pre-contractual/contractual measures). The publication of the Instagram usernames of the winners for the transparency of the campaign is based on Art. 6 (1) lit. f GDPR (legitimate interest in transparent implementation).
Categories of data processed: Instagram username, comment content, interaction data (like/follow/story share), communication content via DM, and, for winners, first and last name, email address, and postal address, if applicable.
Third country transfers: When using Instagram/Meta, processing may take place in third countries (in particular the USA). BRAND has no influence on this; Meta's data protection regulations apply.
Statute of limitations and retention periods (usually 3 to 10 years). Publicly visible comments and Instagram usernames are subject to deletion by the participant on Instagram and are not covered by deletion by BRAND.
Voluntary/necessary: The provision of personal data is voluntary. Without providing the data required for the competition, participation or delivery of prizes is not possible.
